Terms of Service

These Terms govern your use of LensFlip (the "Service"), operated by LensFlip (operated by Jake [YOUR_LAST_NAME], sole proprietor) ("we", "us", or "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

LensFlip is a subscription web app (progressive web app) that lets you scan or photograph items and returns comparable eBay listings, pricing statistics, and an informational buy/pass recommendation. The Service is accessed at www.lensflip.app .

2. Accounts

You must provide a valid email address and a password. You are responsible for keeping your credentials confidential and for all activity under your account. You must be at least 13 years old to use the Service. If you use the Service on behalf of a business, you represent that you are authorized to bind that business.

3. Subscriptions and billing

The Service offers a free tier with daily scan limits and a paid "Pro" tier. Pro is sold as a monthly subscription at $9.99/month or an annual subscription at $79/year, following an optional 7-day free trial. Prices exclude applicable taxes.

Payments are processed by Stripe. By subscribing you authorize us (through Stripe) to charge your payment method on a recurring basis until you cancel. Subscriptions renew automatically at the end of each billing period at the then-current price.

You may cancel at any time from your account settings or by emailing support@lensflip.app . Cancellation takes effect at the end of the current billing period; you retain Pro access until then.

4. Refunds

Subscriptions are billed in advance and are non-refundable for the current billing period, except that we will issue a pro-rated refund for the current period on request within 7 days of the most recent charge if you have not used Pro features during that period. Cancellations take effect at the end of the current billing period.

5. Resale decisions are your own

The Service provides pricing data and informational recommendations based on publicly available listings and algorithmic analysis. The recommendations are not financial advice. eBay prices fluctuate, condition grades are subjective, and identification from a photo is imperfect. Past sale prices do not guarantee future sale prices.

You are solely responsible for your purchasing and resale decisions, for complying with the terms of service of any marketplace you sell on (including eBay), and for paying any taxes owed on your resale income.

6. Acceptable use

You agree not to:

• Reverse engineer, decompile, or extract the source of the Service.
• Automate scraping of the Service or bypass rate limits.
• Resell the Service or its data to third parties.
• Use the Service for any unlawful purpose or in violation of eBay's or any other marketplace's terms of service.
• Upload photographs that contain other people's identifying information, infringe copyright, or depict unlawful content.

7. Intellectual property

The Service, its code, UI, and branding are owned by LensFlip (operated by Jake [YOUR_LAST_NAME], sole proprietor). You retain ownership of photographs and content you upload, and you grant us a limited, non-exclusive, royalty-free license to process them for the sole purpose of providing the Service (e.g., sending them to our image- recognition provider to identify the item).

8. Third-party services

The Service relies on third-party providers, including Stripe (payments), Anthropic (image identification), eBay (pricing data), and Hostinger (hosting). Their services are subject to their own terms and we are not liable for outages or errors on their side.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PRICING DATA WILL BE ACCURATE OR COMPLETE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOSSES FROM RESALE DECISIONS.

11. Termination

We may suspend or terminate accounts that violate these Terms or that we reasonably believe are engaged in fraudulent, abusive, or unlawful activity. You may close your account at any time by emailing support@lensflip.app .

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via email or in-app notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-laws principles. Exclusive venue for any dispute is the state and federal courts located in Washington County, Oregon.
